Personal Data Protection Policy

I. Basic provisions

 

1. The controller of personal data pursuant to Article 4(7) of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as the "GDPR") is  ATONA s. r. o., Poříčí 2428/44, 678 01 Blansko, ID No.: 26226413 (hereinafter referred to as the "controller").

Personal data means any information about an identified or identifiable natural person; an identifiable natural person is a natural person who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, network identifier, or to one or more specific elements of the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

4. The controller has not appointed a data protection officer.

II. Sources and categories of processed personal data

 

1. The controller processes the personal data that you provided to the controller or personal data that the controller has obtained as a result of your browsing and activity on the  www.atona.cz and associated websites of the company branches.

2. The controller processes your identification and contact data and data needed to contact you.

III. Lawful reason and purpose of processing personal data

 

 1. The lawful reason for processing personal data is
• the performance of the contract between you and the controller pursuant to Article 6(1)(b) of the GDPR,
• the controller's legitimate interest in providing direct marketing (in particular for sending commercial communications and newsletters) pursuant to Article 6(1)(f) of the GDPR,
• your consent to processing for the purposes of providing direct marketing (in particular for sending commercial communications and newsletters) pursuant to Article 6(1)(a) of the GDPR in conjunction with Section 7(2) of Act No. 480/2004 Coll., on certain information society services, in the absence of an order for goods or services.

2. The purpose of processing of personal data is
• to process your order and to exercise the rights and obligations arising from the contractual relationship between you and the controller; when placing an order, personal data are required which are necessary for the successful processing of the order (name and address, contact details). The provision of personal data is a necessary requirement for the conclusion and performance of the contract. Without the provision of personal data, it is not possible to conclude the contract or for the controller to perform it,
• to send commercial communications and other marketing activities.

3. The controller does not perform any automatic individual decision-making persuant to Article 22 GDPR.

IV. Data retention period

 

1. The controller retains personal data
• for the period necessary to exercise the rights and obligations arising from the contractual relationship between you and the controller and to assert claims arising from that contractual relationship (for a period of 15 years from the termination of the contractual relationship).
• until the consent to personal data processing for marketing purposes is withdrawn, but for no longer than 10 years if the personal data are processed on the basis of consent.

2. After the expiration of the retention period, the controller shall delete the personal data.

V. Recipients of personal data

 

1. Recipients of personal data are persons
• providing website operation services (Webflow) and other services in connection with the operation of the website,
• providing marketing services,
• Google Analytics - the website uses Google Analytics, a web analytics service provided by Google Inc. ("Google"). Google Analytics uses cookies to enable the analysis of the use of our website. The information generated by cookies about your use of our website is generally transferred to a Google server in the USA and stored there. Google will use this information on our behalf to evaluate your use of our website, to compile reports on website activity and to provide services relating to website and internet usage. Your IP address provided by your browser within Google Analytics will not be aggregated with other data from Google. You can disable the storage of cookies by using the appropriate software settings on your browser. You can also prevent the collection and processing of data generated by cookies about your use of our website (including your IP address) by Google by downloading and installing the appropriate plugin on your browser. 2. The controller intends to transfer the personal data to a third country (non-EU country) or an international organization.

VII. Data security conditions

 

1. The controller declares that it has taken all appropriate technical and organisational measures to safeguard personal data.

2. The controller has taken technical measures to secure data storage and the storage of personal data in paper form.

3. The controller declares that only persons authorised by it have access to the personal data.

VIII. Final provisions

 

1. By submitting an inquiry from the web form (if available), you confirm that you are aware of the personal data protection policy and that you accept it in its entirety.

3. The controller is entitled to amend this policy. It will publish the new version of the personal data protection policy on its website and will also send you the new version thereof to the email address you have provided to the controller.
